I receieved a Nokia N73 from 3 on the 11th October as a upgrade, from the start the joystick was a bit wobbly but got told this was normal. On the 29th of October the joystick fell out, it was in my coat pocket hanging on the peg in the office.

Their saying that the damage was malious and as such it is out of warrenty. Also i was given 7 days to reject my handset if i didn't like it when i took the upgrade. Because of this they want me to pay for the repair, do i have the right to complain and get it repaired under warrrenty.

try the sale of goods act, you were sold an item that wasn't fit for the purpose it was sold for.

Of course you have the right. You didnt break it, so its a defect, and should be covered by the warrenty! The fact you've already reported a call regarding it should be on file.

Threaten them with legal proceedings.

Also find out if this is a common problem. Most companies try this to get out of the warranty contact. there a bit in the sales of goods act that says if the unit has PD due to fair wear then it's should be accepted.
